Welcome to Partners Online Gallery. These Terms and Conditions (“Terms”) govern your access to and use of our website, www.partnersonlinegallery.com (“Website”), including all content, services, and features available through the site.

The Website is owned and operated by Partners Gallery (Pty) Ltd. By accessing or using this Website, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Website immediately.

2. Use of the Website You must be at least 18 years old, or have the consent of a legal guardian, to use this Website. You agree not to misuse the Website, including but not limited to attempting unauthorized access, transmitting malware, spamming, or disrupting services. Content on this Website is provided for general information purposes only and may be updated, modified, or removed without notice.

3. Purchases and Payments All artworks listed are subject to availability and price confirmation. Prices are displayed in South African Rand (ZAR) and may include or exclude VAT, depending on your location. Accepted payment methods include EFT and PayFast. Orders are only confirmed once full payment has been successfully processed and received. We reserve the right to cancel any order prior to shipment if payment is not received or if fraudulent activity is suspected.

4. Shipping and Returns Shipping costs and delivery timelines will be communicated at checkout or via direct correspondence. Delivery times may vary depending on the destination. Unless otherwise required by law, risk of loss or damage in the artwork passes to the customer upon delivery of the artwork to the customer or a person nominated by the customer. If an artwork is returned, the customer remains responsible for the artwork and any risk of damage or loss until it has been received and inspected by Partners Online Gallery. The customer is liable for any damage caused to the artwork while in their possession, or while being returned (whether through their own actions or the actions of any third party or courier engaged for the return), until such time as the artwork is safely in the possession of Partners Online Gallery. Returns are only accepted for undamaged artworks returned within 7 days of delivery, unless otherwise required by law. Returned artworks must be in their original condition and packaging. Customers are responsible for return shipping costs unless the artwork delivered was damaged, defective, or incorrect.

5. Intellectual Property All content on this Website, including but not limited to images of artworks, logos, text, and design, is the property of Partners Online Gallery or the respective artists. You may not copy, reproduce, distribute, or otherwise exploit any content without prior written consent from Partners Online Gallery or the artist concerned.

6. Artist Consignment and Commission Some artworks displayed on our Website or shared via our social media platforms are included under consignment agreements entered into between Partners Online Gallery and the respective artists. All sales of such artworks are subject to commission structures as agreed upon in those contracts. Partners Online Gallery acts as an agent in facilitating the sale of these artworks, and the rights and obligations of both artists and the gallery are governed by their respective agreements.

8. Third-Party Links Our Website may contain links to third-party websites. We are not responsible for the availability, content, or practices of third-party websites, nor do we endorse them.

9. Disclaimer of Warranties All artworks are sold “as is” and Partners Online Gallery makes no representations or warranties, express or implied, regarding the quality, suitability, authenticity, or fitness of the artworks for any particular purpose, except where expressly stated in writing. Partners Online Gallery makes reasonable efforts to ensure the accuracy of information and images of artworks displayed. However, we do not guarantee that descriptions, dimensions, or colours of artworks are perfectly accurate, as variations may occur due to photography, lighting, or display settings.

10. Limitation of Liability Partners Online Gallery is not liable for indirect, incidental, or consequential damages arising from your use of the Website or the purchase of any artworks. To the maximum extent permitted by law, the total liability of Partners Online Gallery for any claim shall not exceed the amount paid by the customer for the artwork giving rise to the claim. We do not warrant that the Website will always function without error, interruption, or security breaches.

11. Indemnity By using this Website, you agree to indemnify and hold harmless Partners Online Gallery, its directors, employees, and agents from and against any claims, damages, liabilities, costs, or expenses arising from your breach of these Terms or misuse of the Website.

12. Force Majeure Partners Online Gallery shall not be liable for any delay, failure, or disruption in the performance of its obligations due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, labour disputes, power failures, or failures in communications or transportation networks.

13. Changes to Terms We reserve the right to modify or update these Terms at any time. Continued use of the Website after changes have been posted constitutes your acceptance of the updated Terms.

14. Governing Law and Severability These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be resolved exclusively by the courts of South Africa. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
